1. Information


1.1 This Site is managed by Monster Worldwide Ltd on behalf of the Department for Work and Pensions (DWP).

1.2 The purpose of this Site and service includes being a self-service venue for:

1.2.1 Employers to post jobs and search for and evaluate job candidates;

1.2.2 Jobseekers to post CVs and Profiles and to search for and evaluate jobs.

1.3 For the purposes of the Employment Agencies and Employment Business Regulations 2003 this Site operates as a venue only and does not introduce or supply work-seekers to recruiters or vice versa.

1.4 In this document, “Our”, “Us” or “We” means DWP of Caxton House, Tothill Street, London, SW1H 9NA and “You” or “Your” is you.

1.5 “Site” means this Universal Jobmatch website.

1.6 If You wish to contact us for any reason, You can do so by using 'contact us'.

1.7 These Terms and Conditions constitute a binding agreement between You and Us and are deemed accepted by You each time that You use or access the Site. If You do not accept the Terms and Conditions stated herein, You should cease to use the Site forthwith.

2. Your obligations


2.1 When using this service You may access or follow links to other online services. These other services may be provided by other government departments, agencies or authorities. Each of these services may have its own Terms and Conditions or licences that apply only to that service and the people that use it. If You use any service You should make sure that You have read all of the terms and conditions for that service.

2.2 You must take reasonable care to prevent the spread of any software contamination including computer viruses when using this Site.

2.3 You agree not to:

2.3.1 use this Site unless You are aged 16 years or over. If You are under the age of 18 You must be supervised by a parent, legal guardian, or other responsible adult;

2.3.2 send, post, distribute, store or destroy information, to or on the Site, that breaks Our Privacy Policy or without prior permission from Us, or by the person whose information is concerned, or which breaks the laws of England and Wales or Scotland;

2.3.3 take any action that puts an unreasonable or overly large load on the Site's infrastructure;

2.3.4 solicit information from anyone under the age of 16;

2.3.5 use any device to navigate or search the Site other than the tools available on the Site, generally available third party web browsers, or other tools approved by Us;

2.3.6 use any data mining, robots or similar data gathering or extraction methods;

2.3.7 break or attempt to break the security of the Site including attempting to probe, scan or test the weaknesses of a system or network or to break security or authentication measures without proper authorization;

2.3.8 forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting;

2.3.9 reverse engineer or decompile any parts of the Site;

2.3.10 aggregate, copy or duplicate in any manner any of the content or information available from any site, including expired job postings, other than as permitted by these Terms and Conditions;

2.3.11 frame or link to any content information available from the Site, unless permitted by these Terms and Conditions;

2.3.12 post any content or material or information that promotes or approves false or misleading information or illegal activities, or approves or provides instructional information about illegal activities or other activities not allowed by these Terms and Conditions;

2.3.13 share Your login credentials to the Site with anyone else;

2.3.14 access data not intended for You, or log into a server or account which You do not have permission to access;

2.3.15 post or submit on the Site any incomplete, false or inaccurate information about yourself or Your business or information which is not Your own or make or use false identities or accounts when using any part of the service;

2.3.16 post content that contains limited or password-only access pages, or hidden pages or images;

2.3.17 remove or alter any content or information posted by any other person or business without their permission;

2.3.18 harass, incite harassment or advocate harassment of any group, company, or individual;

2.3.19 send unwanted mail or email, make unwanted phone calls or send unwanted faxes promoting and/or advertising products or services to any person that uses the service, or contact any person that uses the service who has asked not to be contacted by You;

2.3.20 attempt to damage hardware or software of Ours or other people that use the service, or interfere with service to any other person that uses the Site, host or network, including by (without limitation) sending a virus or other software likely to expose weaknesses or damage to the Site, overloading, "flooding", "spamming", "mailbombing" or "crashing" or attempt to get around functionality designed to protect the privacy and security of any user of this Site;

2.3.21 promote or approve an illegal or unauthorised copy without permission of another person's copyrighted work, by providing or making available pirated computer programs or links to them, providing or making available information to avoid manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

2.3.22 use this Site for any other unlawful purposes;

2.3.23 carry out any actions in relation to this Site if You have received a request from Us to stop those actions;

2.3.24 try to change or add to the content of the Site unless We have given You specific permission to do so.

2.4 The Site enables jobs to be advertised that are to be performed outside of the United Kingdom (being Great Britain and Northern Ireland) (“UK”). Accordingly:

2.4.1 If You are placing a job outside the UK the job must meet all relevant laws in the country where the job is to be based , including but not limited to employment law, any national minimum wage or collective wage agreements, data protection and intellectual property laws.;

2.4.2 Applicants applying for jobs outside the UK must be informed by You that the country where the employment is based will have its own employment law accordingly the applicant may (in the majority of circumstances) not be protected by UK employment law. Accordingly You should advise the applicant of this;

2.4.3 The provisions of clauses 2.4.1.and 2.4.2 will apply in relation to jobs that are placed in the Crown Dependencies of the Isle of Man and the Bailiwicks of Guernsey and Jersey (“Crown Dependencies”);

2.4.4 You should ensure successful applicants are provided with correct work permits/visa before commencing employment;;

2.4.5 You should not advertise jobs where the Foreign and Commonwealth Office “FCO” advises against travel

2.4.6 You shall take appropriate physical, technical and administrative measures to protect any data You have obtained from loss, misuse, unauthorised access, disclosure, alteration or destruction.

2.5 Content of Job Adverts


2.5.1 When using this Site and posting job adverts You agree to:

2.5.1.1 provide a full, clear and accurate job description, which is clearly understandable to jobseekers, of an actual job or work opportunity;

2.5.1.2 Only post jobs in the English and Welsh languages;

2.5.1.3 provide a rate of pay equal to, or more than the National Minimum Wage, and depending upon the age of the successful applicant, a rate of pay equal to or above the National Living Wage (when enacted and as amended from time to time), unless a lawful exemption applies and will clearly state where the vacancy offers a zero hours contract;

2.5.1.4 You must not mislead jobseekers when quoting rates of pay or the salary of a job;

2.5.1.5 If the job is located outside the UK (including location in the Crown Dependencies as set out in clause 2.4.3 above) state the salary amounts and working pattern and ensure that they meet all relevant laws in the host country in accordance with clauses 2.4.1 and 2.4.2;

2.5.1.6 adhere to all relevant UK legislation, and all required licences must be in place;

2.5.1.7 adhere to the requirements of UK government departments, for example HMRC, BIS, Home Office, HSE. Note such list is not exhaustive;

2.5.1.8 ensure that all adverts are available to jobseekers on an open and fair basis;

2.5.1.9 only advertise and continue to manage jobs with the permission of the vacancy owner and do not to duplicate a job which You have already posted on the Site.

2.5.1.10 clearly state any and all costs that might be incurred as part of the application process and any and all on-going costs must be clearly stated in the job description;

2.5.1.11 advertise a job only where a vacancy exists, for example not for the purposes of building a database of potential candidates;

2.5.1.12 ensure all apprenticeship job descriptions contain the word 'Apprenticeship' in the job title, and include the qualification that the apprentice will work towards, the length of the apprenticeship and the name of the employer.

2.6 You agree not to use the following in a job posting:

2.6.1 premium rate telephone numbers;

2.6.2 income generating phone numbers (070 and 09 prefixes);

2.6.3 0871, 0872, 0873 telephone numbers where the call duration exceeds 5 minutes;

2.6.4 material or links to material that takes advantage of people in a sexual, violent or other manner;

2.6.5 requests for job seekers to use their own personal auction listing account(s).

2.7 You agree not to advertise the following types of jobs on this Site:

2.7.1 jobs for sexual services or seeking employees for jobs of a sexual nature. Any jobs placed within the adult entertainment industry must only be for the purposes of a) selling, manufacturing and distributing of adult entertainment products b) Ancillary staff e.g. cleaners and bar staff and c) jobs must display the age requirement of 18 or over. No other adult entertainment jobs will be accepted;

2.7.2 commission only opportunities, unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the jobseeker would be selling and confirms that the vacancy can achieve a wage equivalent to or more than the National Minimum Wage and/or the National Living Wage (when enacted) and as amended from time to time;

2.7.3 self-employed commission only or piecework opportunities unless the job description complies with HMRC Requirements and which must clearly state the products/services applicable to the vacancy, including where there is a requirement to recruit members; any up front or periodic costs that might be incurred by the jobseeker; agency administration fees for the payment of self-employed National Insurance contributions (where applicable); that an income equivalent or more than to the National Minimum Wage (NMW) can be achieved and depending upon the age of the successful applicant a rate of pay equivalent to or more than the National Living Wage (when enacted) and as amended from time to time.;

2.7.4 fundraising opportunities without the express permission of the charity involved;

2.7.5 jobs specifically intended to provide cover for workers involved in an official trade union dispute;

2.7.6 jobs offering allowances or expenses only for example, voluntary, community or fostering opportunities. They can however be advertised as local opportunities through Jobcentre Plus;

2.7.7 jobs which involve a trial or probationary period without pay;

2.7.8 jobs that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations, or government contract;

2.7.9 jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job.

2.8 Vacancy Management


2.8.1 You agree to:

2.8.1.1 close the vacancy promptly, and in any event when it is no longer available for applications or is filled;

2.8.1.2 take all steps to avoid duplication of the same vacancy advertisement, for example through the bulk upload facility and not advertise more vacancies than there are jobs available;

2.8.1.3 ensure that any hyperlinks/active images/images with information only lead directly to the vacancy being advertised;

2.8.1.4 not to contact jobseekers unless it is about a job and they have indicated that they are willing to be contacted. You agree to only contact them in the manner that they have specified they wish to be contacted. You agree not to use jobseeker details for any other purpose unless expressly agreed to by the job seeker;

2.8.1.5 Only collect personal information from jobseekers where there is a legitimate reason to do so. The following information must not be requested until a formal job offer has been made and accepted a) National Insurance Number, b) Passport details; c) Bank Account details;

2.8.1.6 If You wish to ask a jobseeker for documentation of their right to work in the UK they must only ask for documentation as specified in the Home Office’s 'An employer’s guide to acceptable right to work documents'. This does not include a driving license or bank account details.

3. Your rights


3.1 This Site is protected by intellectual property rights and this clause sets out the intellectual property rights that We do have in the Site and the extent to which these may be reused by You. An integral feature of this Site is that live employment opportunities are posted onto the Site by or on behalf of employers and individual users post CVs. As a result, since We have not created all the features of this Site We do not own all the intellectual property rights of every aspect of the Site.

3.2 “User Content” means all information, data, text, software, photographs, messages or other materials submitted, posted or displayed by You and other users of this Site.

3.3 The submitter of User Content retains all intellectual property rights in it and is responsible for protecting those rights.

3.4 Subject to clause 3.5 We claim no ownership or control over any User Content.

3.5 We reserve the right to refuse to accept, post or transmit any User Content.

3.6 All material on this Site other than User Content is owned by Us and as a result the copyright and all other intellectual property rights (including all database rights, trade marks, text, graphics, code and links) belong to Us and are subject to Crown Copyright protection and may be reused subject to the term of the Open Government Licence.

4. Our obligations


4.1 Subject to the following provisions in clause 4.2, We will do Our best to make sure that content on this Site is correct and up to date. If We have missed out any information or any mistakes are identified We will correct it as soon as possible.

4.2 We cannot guarantee the availability or accuracy of data and information in the following cases:

4.2.1 on any linked website and We are not responsible for the results of You using the information or services on linked websites;

4.2.2 that the links to any linked websites will work all of the time;

4.2.3 of any particular service either provided by Us or by another government department, agency or authority.

4.3 A link to another website does not mean that We have checked the information given or that We approve or support any specific commercial product or business on that site. You must decide whether the information or service on that website is suitable for Your needs. If a website is not linked to Ours this does not mean that We think that the information on it is not useful or correct.

4.4 In the interests of all the people that use the Site We will co-operate with investigations by any law enforcement agency or relevant authority where they are investigating suspected criminal activity or violation of computer systems or networks.

4.5 We, Our suppliers and Our employees will not pay damages for any loss that You may suffer because:

4.5.1 of any failure by Us to comply with these Terms and Conditions, where it is because of circumstances out of Our reasonable control;

4.5.2 of a withdrawal of this Site;

4.5.3 You have used, or relied on the accuracy of, the information on Our service; or

4.5.4 disruption to Your computer system or damage or loss of data caused by using this Site or as a result of having used the Site. It is Your responsibility to have adequate security protection on Your computer against viruses, malicious codes and similar threats.

4.6 We deny any responsibility for any postings or transmissions on this Site which are unlawful, defamatory, obscene, offensive or scandalous, or any material that constitutes or encourages, or is likely to encourage conduct that breaches the law in any way.

4.7 We will not be contractually bound by any of Your actions or statements.

4.8 If You make a complaint We will follow Our standard complaints procedures in respect of job advertising.

5. Our rights


5.1 We reserve the right to make changes to these Terms and Conditions at any time by posting an updated version on the Site. It is Your responsibility to keep up to date with changes to the Terms and Conditions by visiting the Site at regular intervals as You will be bound by the most recent Terms and Conditions.

5.2 We may remove the Site at any time without notice.

5.3 If You breach the Terms and Conditions We may, without notice:

5.3.1 remove Your details from the Site and/ or stop You from using the Site;

5.3.2 edit Your details held on the Site.

5.4 You are responsible for Your posting and the management of Your account. If We are asked to pay damages because We have advertised Your posting or because of the way You have managed Your account on the Site You agree to pay those damages back to Us.

5.5 We may limit the amount of information (including CV views) that may be accessed by You in any given time period.

5.6 When Your account is closed all of the information in it, including saved CVs, network contacts and email mailing lists may be marked as deleted by Us and removed from Our databases. Information may continue to be available for some period of time because of delays in processing the closure.

5.7 We reserve the right to refuse vacancies and to withdraw access and use of the Site to organisations and individuals who may (in Our opinion) damage the integrity and/or perception and public standing of Us or the Site. By way of example this could include jobs that are posted on the Site specifically to undermine Our policies or to damage Our reputation.

5.8 Where We do not pursue any rights available to Us under these Terms and Conditions on any occasion, this does not mean that We will not pursue those rights in the future.

5.9 In the event that a criminal offence is committed We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them.

6. Data protection


6.1 Information You provide to Us may be passed to relevant service providers, including government departments, agencies or authorities, for example in order to respond to any query You have made with Us or process any application You may have made. Your information will be managed in accordance with the law, including the Data Protection Act 1998. For further information please read Our Privacy Policy.

6.2 We will comply with Our legal obligations to keep Your information safe and secure, but We cannot guarantee the absolute safety of any information that You send to Us. This means that You send Us information at Your own risk. We will not pay You any damages to cover any loss that has resulted from someone accessing the service without permission or making changes to information on the Site, except for where Our employees or agents are at fault.

7. User content


7.1 “User Content” means all information, data, text, software, photographs, or other materials, submitted, posted or displayed by You on the Site.

7.2 User Content is the sole responsibility of the person from which the User Content originated. The person who submits User Content retains all patent, trademark and copyright to the User Content they submit and that person is responsible for protecting those rights. However, You agree not to breach the patents, trademarks and copyrights of other users of the Site, and a breach of those rights will be a breach of these Terms and Conditions.

7.3 If You submit User Content to this Site You grant Us a worldwide, non-exclusive, royalty-free licence to reproduce, adapt, distribute and publish the User Content through this Site.

7.4 We claim no ownership or control over any User Content. We have no obligation to check the content of User Content, unless We receive a complaint in relation to specific User Content.

7.5 We reserve the right to refuse to accept, post, display or transmit any User Content as We choose.

7.6 We do not guarantee the truthfulness, accuracy, or reliability of User Content or of any other information supplied by other users of this Site. We do not approve any opinions made by people using this Site. If You rely on any of the information posted by other people using this Site You do so at Your own risk.

8. General


8.1 We make every effort to check and test material at all stages of production, however You must take Your own precautions to ensure that the process which You employ for accessing this Site does not expose You to the risk of viruses, malicious computer code or other forms of interference which may damage Your own computer system.

8.2 We do not accept any responsibility for any loss, disruption or damage to Your data or Your computer system which may occur whilst using material derived from this Site.

8.3 This Site and the use of it are governed by English Law. The English Court system shall have exclusive authority over any disputes connected to or arising out of the use of this Site.

8.4 If You use information or services provided on the Site from outside the UK, You do so at Your own risk and You are responsible for checking local laws and not doing anything to break them.

8.5 If any of these Terms and Conditions are held invalid, void, or for any reason unenforceable, that term or condition will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.
